1. Scope
These terms govern the use of FellDesk, a service by NordheideStudios.de, owned by Christopher Richter, Kirchweg 7a, 21244 Buchholz, Germany.
This offer is directed exclusively at business operators within the meaning of § 14 of the German Civil Code (BGB) — i.e. commercially or independently active dog groomers, pet sitters and dog walkers. By registering, you accept these terms.
2. Description of Services
FellDesk provides web-based software for managing appointments, pet profiles and client data. The scope of functionality depends on the plan booked. The software is provided as a service over the internet; no installation takes place on the customer's side.
We continuously develop FellDesk further. Features may be added, changed or – for good reason and while preserving the contractually agreed core scope – discontinued. We inform customers of material changes in advance by email.
3. Plans, Prices and Billing
The prices stated at the time of booking apply:
- Free – €0 free forever: up to 5 clients, unlimited pet profiles per client and unlimited appointments.
- Basic – €19 per month: up to 20 clients, unlimited pet profiles per client and unlimited appointments.
- Pro – €39 per month: up to 50 clients, unlimited pet profiles per client and unlimited appointments.
- Business – €79 per month: unlimited clients, unlimited pet profiles per client and unlimited appointments.
All prices are final prices. Pursuant to § 19 UStG (German small business regulation), no VAT is charged or shown.
Paid plans are billed monthly in advance through our payment provider Stripe Payments Europe, Ltd. Subscriptions automatically renew for one month at a time unless cancelled before the renewal date. No refund is given for billing periods already begun.
If a payment fails, access may be suspended until the balance is settled. Stored data is unaffected by this.
4. Term and Termination
Paid plans run monthly and can be cancelled at any time, effective at the end of the current billing period – without giving reasons, via the Stripe customer portal under "Plan & Billing".
After cancellation, access continues on the free Free plan. Existing pet profiles remain visible; new ones can only be created once the count falls below the Free plan's limit.
You may have your account deleted entirely at any time. All data will then be permanently removed within 30 days, unless statutory retention obligations require otherwise.
5. User Obligations
You are responsible for the content you enter into FellDesk, in particular for the lawfulness of processing your own customers' personal data. In particular, no content may be entered or uploaded that
- infringes third-party rights, in particular copyright, trademark or personality rights,
- is insulting, defamatory, threatening or harassing,
- contains malware or harmful code,
- violates applicable German or European law.
Login credentials must be kept confidential. Any suspicion of unauthorized use of the account must be reported to us immediately.
6. Data Processing on Our Behalf (DPA under Art. 28 GDPR)
For the client, pet and appointment data you enter in the portal, you are the controller within the meaning of the GDPR. FellDesk processes this data strictly on instruction, acting as a processor under Art. 28 GDPR.
Upon registration or conclusion of contract, the parties simultaneously enter into the Data Processing Agreement (DPA) required by Art. 28(3) GDPR on the basis of these Terms. No separate agreement requested by email or signed physically is required. Details are governed by our Privacy Policy.
7. Availability
We aim for 99% availability on a yearly average, excluding announced maintenance windows and disruptions outside our control. There is no entitlement to uninterrupted availability.
8. Data Backup
We perform regular backups of the database. These serve to restore service in the event of a disruption and do not replace your own backup. Exporting your own data is your responsibility as the customer.
9. Liability
We are liable without limitation for intent and gross negligence, as well as for injury to life, body or health. In cases of ordinary negligence, we are liable only for breach of a material contractual obligation and limited to foreseeable damage typical for this type of contract.
Pursuant to § 10 TMG, we are not liable for content entered by users unless we are aware of unlawful content and fail to act.
10. Suspension and Termination by Us
We reserve the right to remove content and to suspend or terminate accounts that violate these terms. In the event of serious violations, termination without notice and without prior warning is possible. We report unlawful content to the competent authorities.
11. Reporting Abuse
Please report indications of unlawful or abusive content to hello@felldesk.eu. We review every report and respond within 48 hours.
12. Applicable Law and Jurisdiction
The law of the Federal Republic of Germany applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction for all disputes arising from this contractual relationship is Buchholz in der Nordheide, provided the customer is a merchant, a legal entity under public law, or a special fund under public law.
13. Changes to these Terms
We reserve the right to amend these terms. We will inform customers of material changes at least four weeks before they take effect, by email. If you do not object within this period, the amended terms are deemed accepted. We will specifically point out this consequence in the notice.
14. Severability Clause
Should any provision of these terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
